29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  (a) Back side, new townhome construction located at 5205 Whiteoak Avenue, Smyrna, GA 30080: Employee was exposed to overhead struck-by hazards while using a tagline to guide a truss being hoisted by a crane to the top plate without head protection. A hard hat was not provided by the employer to perform this overhead work activity.

29 CFR 1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:  (a) Back side, new townhome construction located at 5205 Whiteoak Avenue, Smyrna, GA 30080: Employee was exposed to amputation/severe laceration hazards while cutting 1/2" OSB plywood sheathing with a Makita 7-1/4-inch Circular Saw with the guard propped open with a wood shim.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.  (a) Top plate, new townhome construction located at 5205 Whiteoak Avenue, Smyrna, GA 30080: Employer was exposed to potential eye injuries while operating a Hitachi (Model NR83A-S1) Strip Framing Nail Gun without eye protection. The employer installing roof trusses with 3-inch plastic collated nails with the compressor air set at 120 PSI was not provided with safety glasses or goggles while operating these tools.   Benito Rubio was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 954626, citation number 1, item number 1 and was affirmed as a final order on 03/17/2014, with respect to a workplace located at 424 Wade Farm Drive, Powder Springs, GA 30127.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) Top plate, new townhome construction located at 5205 Whiteoak Avenue, Smyrna, GA 30080: Employees were exposed to falls of approximately 20-feet, 5-inches while installing roof trusses on the top plate of a 2-story structure with no fall protection system in place.  Benito Rubio was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 954626, citation number 1, item number 2 and was affirmed as a final order on 03/17/2014, with respect to a workplace located at 424 Wade Farm Drive, Powder Springs, GA 30127.
