29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   Marine Terminal:  On or about June 12, 2014 and at times prior thereto, the employer had not developed and implemented a written Hazard Communication program where chemicals such as DM-7 Lubricating Moisture Repellant and NAPA Chain & Cable Lube were used in the workplace.  This condition limited employee's knowledge of the hazards of chemicals in their workplace.  General Industry standard applicable to Marine Terminal employment.

29 CFR 1917.43(b)(1): Modifications (such as adding counterweights) that might affect the powered industrial trucks capacity or safety were performed without either the manufacturers prior written approval, or the written approval of a professional engineer experienced with the equipment who had consulted with the manufacturer:  Marine Terminal:  Written approval for forklift extensions utilized on the Taylor 800, FLTU 8011 powered industrial  truck (P.I.T.) were not available.  This condition may affect the rated capacity of the P.I.T.
