29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On or about 6/18/14, on the flat roof of a Tim Hortons Restaurant under renovation at 6339 Transit Road, Lancaster, NY: Two employees were exposed to a potential fall of 15 ft. to the ground while constructing an addition to the front top Fascia and transporting materials on the roof. No fall protection system was utilized to protect the employees. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) On or about 6/18/14, on the flat roof of a Tim Hortons Restaurant under renovation at 6339 Transit Rd., Lancaster, NY: Two employees using an extension ladder to access the roof were exposed to a potential fall of approx. 15 ft. to the ground because the siderails of an extension ladder used to access the roof landing point only extended approx. 18 inches above the edge of the roof. NO ABATEMENT CERTIFICATION REQUIRED
