29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were other provisions of paragraph (b) of this section used to provide an alternative fall protection measure: At the jobsite located at 1611 N. 105th Street, Omaha, NE 68114: The employer is failing to ensure that employees engaged in residential construction activities were protected from falls while working at heights greater than 6 feet from lower levels. On or about June 19, 2014; employees of Jesus Flores were observed performing residential roofing installation while exposed to a fall heights of 12 to 18 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: Jesus Flores dba Flores Roofing: The employer failed to provide a training program to ensure that employees are able to recognize and minimize hazards when exposed to falls greater than 6 feet. Employees were observed performing roofing activities at heights greater than 6 feet without using any convention fall protection; none of the employees had received training from their employer.
