29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.  a) worksite - Employees installing shingles with a pneumatic nail gun were not wearing eye protection; on or about 06/24/2014.  Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) worksite - Employees installing shingles on an approximate 8-12 pitch roof approximately 22 feet above the ground were not protected from falling; on or about 06/24/2014.  Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.  TORPOL CONSTRUCTION LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 315535310, citation number 1, item number 2, and was affirmed as a final order on 11/07/2011, with respect to a workplace located at 26 Dock Lane, Kings Point New York 11024.  TORPOL CONSTRUCTION LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 314295338, citation number 1, item number 2 and was affirmed as a final order on 11/18/2010, with respect to a workplace located at 9 Dingletown Road, Stamford CT 06905.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:  a) worksite - Employees installing shingles on an approximate 8-12 pitch roof approximately 22 feet above the ground were not protected from falling. The employees did not recognize the hazard and means to correct the hazard, the employees were not trained; on or about 06/24/2014.  Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
