29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a yard tractor.      a)      On or about June 24, 2014, the employer did not assure that employees successfully completed an operator training program containing elements in 29 CFR 1910.178(l) before employees were permitted to operate the yard tractors.    AVD amended to read:  &.the employer did not assure that employees completed a compliant operator training program, in that, the employers training program did not include the formal training requirement.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s)    a)      On or about June 24, 2014, the employer did not assure that the Ottawa yard truck 00 (Model 30, Serial# 74124) was removed from service during a time in which it was in need of repair.  Employees were exposed to injuries related to unsafe operating conditions in that the horn was not functioning.        b)      On or about June 24, 2014, the employer did not assure that the Ottawa yard truck 01 (VIN 328838) was removed from service during a time in which it was in need of repair.  Employees were exposed to injuries related to unsafe operating conditions in that the horn and back up alarm were not functioning.      c)      On or about June 24, 2014, the employer did not assure that the Ottawa yard truck 02 (VIN 328839) was removed from service during a time in which it was in need of repair.  The yard truck was not in a safe operating condition in that the windshield was cracked potentially obstructing the operators view.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service:  a)      On or about June 24, 2014, the employer did not assure that the Ottawa yard truck 00 (Model 30, Serial# 74124) was examined for conditions that adversely affect the trucks safety before being placed into service.  The yard truck was not in a safe operating condition in that horn was not functioning.     b)      On or about June 24, 2014, the employer did not assure that the Ottawa yard truck 01 (VIN 328838) was examined for conditions that adversely affect the trucks safety before being placed into service.  The yard truck was not in a safe operating condition in that horn and back up alarm were not functioning and the windshield was cracked potentially obstructing the operators view.      c)      On or about June 24, 2014, the employer did not assure that the Ottawa yard truck 02 (VIN 328839) was examined for conditions that adversely affect the trucks safety before being placed into service.  The yard truck was not in a safe operating condition in that the windshield was cracked potentially obstructing the operators view.
