29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets: West side of the fertilizer storage bins: On or about June 19, 2014, an employee operating the crane was not wearing a hard hat while walking through the construction area. This exposed the employee to the hazard of being struck in the head by falling objects.

29 CFR 1926.1424(a)(2)(ii): To prevent employees from entering hazard areas, the employer did not erect and maintain control lines, warning lines, railings or similar barriers to mark the boundaries of the hazard areas: West side of the fertilizer bins: On or about June 19, 2014, the crane used to lift and install the components of a fertilizer handling system did not have its swing radius guarded. This exposed the fertilizer system installation contractor employees to the hazards of be struck by the crane the moving superstructure and/or being caught between the moving superstructure and the stationary chassis.
