On or about June 23, 2014, in the facility, employee(s) required to remove asbestos-containing vinyl floor tiles in the graphic artist room were potentially exposed to the hazard of contact with chrysotile asbestos. Vacuum cleaners equipped with HEPA filters were not used to collect debris and dust.

29 CFR 1926.1101(g)(1)(ii): The employer shall use the following engineering controls and work practices in all operations covered by this section, regardless of the levels of exposure: Wet methods, or wetting agents, to control employee exposures during asbestos handling, mixing, removal, cutting, application, and cleanup, except where employers demonstrate that the use of wet methods is infeasible due to for example, the creation of electrical hazards , equipment malfunction, and, in roofing, except as provided in paragraph (g)(8)(ii) of this section. On or about June 23, 2014, in the facility, employee(s) required to replace asbestos-containing vinyl floor tiles in the artist room were potentially exposed to the hazard of contact with chrysotile asbestos. 29 CFR 1926.1101(k)(9)(iv)(A): The employer shall train each employee who is likely to be exposed in excess of the permissible exposure limit (PEL), and each employee who performs Class I through IV asbestos operations. For work with asbestos containing roofing materials, flooring materials, siding materials, ceiling tiles, or transite panels, training shall include at a minimum all the elements included in paragraph (k)(9)(viii) of this section and in addition, the specific work practices and engineering controls set forth in paragraph (g) of this section which specifically relate to that category. Such course shall include "hands-on" training and shall take at least 8 hours: On or about June 23, 2014, in the facility, employee(s) required to replace asbestos-containing vinyl floor tiles (Class II asbestos work) in the artist room were potentially exposed to the hazard of contact with chrysotile asbestos. The employer did not provide the required training to each employee who performed Class II work.
