29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person: On or about July 2, 2014, at 2115 Creekside, New Braunfels, TX, the employer erected a set of scaffold support braces from nominal lumber at the jobsite. The support system was not designed by a qualified person and a load rating with safety factors was not known. Employees applying Tyvek on the building were exposed to a fall hazard of 11 feet due to potential structural failure of the scaffold brackets.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: On or about July 2, 2014, at 2115 Creekside, New Braunfels, TX, the employer failed to provide fall protection with guardrails or personal fall arrest systems. Employees were applying Tyvek on the building from a make-shift scaffold and were exposed to a fall hazard greater than 11 feet.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: On or about July 2, 2014, at 2115 Creekside, New Braunfels, TX, the employer failed to ensure employees were trained to recognize the fall hazards and procedures to control and minimize those hazards. Employee was working from scaffold supported by make-shift braces with a platform height of eleven feet high with no fall protection or guardrail system.
