29 CFR 1910.178(n)(4): The driver was not required to slow down and sound the horn at cross aisles and other locations where vision is obstructed: a) Lumber yard: On July 9, 2014 the horn on the Hyster (modelH210XL) forklift was not functional. The forklift was operated in and out of the storage warehouse, around the open bay storage areas and through-out the yard. Note) Abatement certification IS required for this item.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by or crushing hazard when operating forklifts without the use of a restraint device: a) Lumber yard: On July 9, 2014 an employee operated the Hyster (model H135XL) powered industrial truck (forklift) without a seatbelt in place. Blue North Forest Products, LLC was previously cited for a violation of this occupational safety and health standard Section 5(a)1 of the Occupational Safety and Health Act of 1970, which was contained in OSHA inspection number 315027029, citation number 1, item number 1 and was affirmed as a final order on April 29, 20122, with respect to a workplace located at 283 Woodland Road, Kamiah, ID 83536.
