29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s): (a)Blackeagle Energy Services at 230 Commerce Drive, Berthoud, CO 80513: On and before 6/26/14, the employer did not ensure the point of operation on the press brake was guarded to prevent employees from having any part of the their body in the danger zone during operation in that the employees were not protected by safe distance nor was a physical barrier in place. This hazard exposed the employees to an amputation hazard. Abatement Note: Press brake safeguarding can be accomplished by using one of the following: (a)Presence Sensing Device - Designed to automatically stop the machine when the sensing field is interrupted. (b)Two-Hand Control Device - Designed to keep the operators hands away from the point of operation by requiring two hands to engage the machine. (c)Pullback Device - Designed to pull the operator's hands away from the area of the closing dies during each stroke of the press. (d)Restraint Device - Designed and adjusted so that the operator can never reach the point of operation. Two-hand control, as a point of operation safeguarding device for press brakes, is ideal for short-run job-shop operations. Piece parts can vary from quite small to very large. The steps are as follows: Step 1By depressing the control buttons, the operator initiates the press brake stroke. Step 2The operator must hold the buttons until the slide completes its downward travel. If the operator removes a hand from one of the controls, the slide will stop. In the single stroke or Hi/Lo mode, the slide will make one complete stroke. Step 3In the sequence mode, the slide will automatically stop at a preset position 1/4" or less above the work piece. This position is adjustable for different feed-line heights or material thickness. Step 4If the work piece is not already placed in the die, it may be inserted at this time. Step 5The two-hand control or the foot switch is now re-initiated, causing the slide to continue through the bottom of the stroke and finishing at top dead center (TDC). Abatement Note: Safeguarding of power press brakes is covered by American National Standards Institute standard ANSI B11.3-1982. OSHA recognizes this ANSI standard as the national consensus standard covering power press brake guarding. ANSI B11.3-1982, Paragraph 6.1.4.3 specifically addresses safeguarding by maintaining a "safe distance" is acceptable if the employer demonstrates that power press brake point of operation guarding by maintaining a safe distance is limited to one-time only fabrication of made-to-order or custom-made piece parts. Small quantity runs, typically performed in job shop or model shop establishments may be affected by this provision; high volume piece part rates of production will not. A "small quantity run" means fabrication of more than one of the same piece parts over a continuous timeframe of no more than four hours per month. OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards: (a)Blackeagle Energy Services at 230 Commerce Drive, Berthoud, CO 80513: On and before 6/26/14, the employer did not ensure the pallet lifter device was designed by or under the direct supervision of a qualified person. The design shall be in accordance with ASME BTH-1 and shall consider the stresses resulting from the application of rated load plus the weight of the device. The condition exposed employees using the pallet lifting device to struck by and crushing hazards as a result of the lifting device failing. Abatement Note: Among other methods, one feasible and acceptable abatement method can be found in the American Society of Mechanical Engineers, ASME B30.20-1.2.2 Construction, "Structural and mechanical lifting devices shall be designed to ASME BTH-1 Design Category B (static strength criteria) selected for its number of load cycles, unless a qualified person representing the owner, purchaser, or user of the lifting device determines and can demonstrate that ASME BTH-1 Design Category A is appropriate. Design Category A shall only be designated when the magnitude and variation of loads applied to the lifter are predictable and do not exceed the rated capacity, where the loading and environmental conditions are accurately defined, service is not severe, and the anticipated load cycles do not exceed Service Class 0. (b)Blackeagle Energy Services at 230 Commerce Drive, Berthoud, CO 80513: On and before 6/26/14, the employer did not ensure the pallet lifter or below the hook lifting device was rated prior to initial use. The pallet lifter was utilized to lift in excess of 1000 lbs for materials and did not have the rated load visibly marked or identification affixed listing the manufacturers name and address, serial number and lifting device weight. Among other methods, one feasible and acceptable abatement method can be found in the American Society of Mechanical Engineers, ASME B30.20-Below-the-hook Lifting Devices, section 20-1.2.1 Marking, Rated Load-All new structural and mechanical lifting devices shall be marked with, but not limited to, the following information: 1) Manufacturers name and address 2) Serial number 3) Lifter weight, if over 100 lb 4) Cold current (amps)(when applicable) 5) Rated voltage (when applicable) 6) Rated load 7) ASME BTH-1 Design Category 8) ASME BTH-1 Service Class

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught between and struck-by hazards: (a)Blackeagle Energy Services at 230 Commerce Drive, Berthoud, CO 80513: On and before 6/26/14, the employer did not ensure Ingersoll Rand #5108 rough terrain forklift lift truck was inspected prior to use and removed from service when unsafe conditions existed. The pipe swivel attachment was damaged, removed, and put back into service and used by employees. This condition exposed employees to caught between and struck by hazards. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to perform the following: ASME B56.6-1992, American Society of Mechanical Engineers, Section 6.5.1 At the beginning of each shift and before operating the rough terrain truck, check its condition, giving special attention to: (a)tires and their inflation pressure; (b)warning devices; (c) lights; (d)lift and tilt systems, loading-engaging means, chains, cables, and limit switches; (e)brakes; (f)steering mechanisms; (g)fuel systems Abatement Note; Among other methods, one feasible and acceptable abatement method to correct this hazard is to perform the following: ASME B56.6-1992, American Society of Mechanical Engineers, Section 6.5.1.1 "If the rough terrain forklift truck is found to be in need of repair or in any way unsafe, or if it contributes to an unsafe condition, the matter shall be reported immediately to the user's designated authority, and the truck shall not be operated until it has been restored to safe operating condition.
