29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. a. On the west side of the building where an employee was handing up to the second floor 2 x 10 boards for headers, the employee was not required to wear head protection thereby exposing employees to a struck-by hazard.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a. On the second floor balcony where the employee was loading trash into a raised trash container on the front of a rough terrain forklift, the employer did not provide fall protection thereby exposing employees to a 10 foot fall hazard.

29 CFR 1926.501(b)(14): "Wall openings." Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 m) above the walking/working surface, shall be protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. a. On the second level of the building where employees were pulling up boards from the ground to build headers, the employer did not provide a fall protection system such as, but not limited to, a guardrail where the bottom of the wall was 24 1/2 inches high where the employee was standing thereby exposing the employee to a 10'6" fall hazard.
