Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazard of being caught between the top of the operators cab of a Crown Sideshifter 30RDTT-S reach truck and the horizontal shelves of storage racks which can enter the operator's compartment when the truck is traveling in reverse or making sharp turns. In the PDC Warehouse, employee(s) operating Crown Sideshifter reach trucks in the warehouse, transporting product were exposed to under-ride hazards where the lift truck could travel under the storage rack(s). On June 4, 2014 a 30RDTT-S lift truck travelled under storage rack location P-18A, and the operator was crushed between the top of the deck of the operator's cab and the horizontal member of the rack. Other operators continued to use this model of truck while working in the warehouse. The lift was observed in operation again in the same area of the warehouse under the same conditions on July 2, 2014.
