29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: (Construction Reference 1926.103) (a) at Shell Deer Park, Aromatics Concentration Unit (ACU), enclosure "Z", employees are exposed to inhalation hazards while conducting a Thermal Spray Aluminum process using half-face respiratory protection. The contaminants and levels of aluminum, beryllium, hexavalent chromium, copper, lead, magnesium, manganese, nickel, iron, vanadium, and zinc oxide have not been determined to ensure adequate respiratory protection. (b) at Shell Deer Park, ACU, enclosure "Z", employees are exposed to inhalation hazards in a confined space during surface coating removal. The levels of respirable dust have not been measured to ensure adequate engineering controls.

29 CFR 1910.1200(h)(3)(ii): Employee training did not include the physical and health hazards of the chemicals in the work area (Construction Reference 1926.59): a) at Shell Deer Park, ACU, containment # 7, employees had not received effective training on the inhalation hazards involving thermal spray aluminum (TSA). This process produces hazardous chemicals such as metal fumes, carbon monoxide, carbon dioxide, nitrogen oxides, ozone and respirable dusts.
