29 CFR 1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  Moore Roofing, Inc. did not provide certification on each of the cited items:  a.    Retraining on the requirements to use fall protection when performing roofing work.  b.    The employer did not ensure that the extension ladder used to access and exit the roof area extended at least three feet above the roof.  c.     The employer did not ensure that employees had access to Safety Data Sheets in case of an emergency or by request.  d.    The employer did not ensure that Safety Data Sheets were made available upon request from the designee of the Assistant Secretary.

Moore Roofing, Inc. did not provide abatement documentation for the following cited item:  a.    The employer did not ensure that employees were provided with, and used some means of fall protection while performing roofing activities.

When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer shall retrain each such employee. Circumstances where retraining is required include, but are not limited to, situations where:   29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.     a)     At the workplace, the employer did not ensure that employees had a clear understanding of the requirements to use fall protection when performing roofing work at heights greater than six feet.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.     a)     At the worksite, the employer did not ensure that the extension ladder that was used to access/exit roof area was extended at least three feet above the working/walking surface, thereby exposing employees to a potential trip/fall hazard.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.     a)     At the worksite, the employer did not ensure that employees were provided and used some means of fall protection when performing roofing work at heights greater than six feet, thereby exposing employees to an approximate 20 foot fall hazard.    Moore Roofing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 754801, citation number 1, item number 1 and was affirmed as a final order on January 07, 2013, with respect to a workplace located at 2744 Dover Road, Columbus, Oh 43209.

29 CFR 1910.1200(g)(9): Where employees must travel between workplaces during a workshift, i.e., their work is carried out at more than one geographical location, the material safety data sheets may be kept at the primary workplace facility. In this situation, the employer shall ensure that employees can immediately obtain the required information in an emergency.      a)     At the worksite, the employer did not ensure that employees had access to Safety Data Sheets, in case of an emergency or by request, for hazardous chemicals such as, but not limited to Xylene and JM TPO Membrane Adhesive (Solvent Based), thereby exposing employees to potential Health and Safety hazards.
