29 CFR 1910.134(c)(1): In any workplace where respirators were necessary to protect the health of the employee or whenever respirators were required by the employer, the employer did not establish and implement a written respiratory protection program with worksite-specific procedures:    (a)  Gabco Masonry, Inc. - The employer required employees who were exposed to respirable silica dust to wear respirators, but the employer did not establish a written respiratory protection program, on or about July 25, 2014.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

Abatement certification required within 10 days after abatement date. 29 CFR 1910.134(g)(1)(i)(A): The employer permitted respirators with tight fitting facepeices to be worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:  (a)  Gabco Masonry, Inc. - The employer allowed the mixer employee to wear a tight-fitting respirator over his beard, on or about July 25, 2014.  Abatement certification required within 10 days after abatement date. 29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:  (a) Gabco Masonry, Inc., Harrisburg, Pennsylvania - Employees cutting concrete were exposed to silica dust, which classifies as a hazardous chemical, and the employer did not provide employees with training on the revised hazard communication standard (HCS 2012) label elements and the new format and type of information on each section of the safety data sheets (SDSs) to ensure that when employees began to see HCS 2012 compliant labels and SDSs in their workplace, employees would understand how to use the labels and SDSs and access the information effectively, on or about July 25, 2014.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
