29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) Florence & Broadway, Union Beach, NJ: On or about 7/28/2014, two K&M Contracting employees in a trench excavation, working in the proximity of the excavator, were exposed to overhead struck-by hazards and were not wearing hard hats.

29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation: a) Florence & Broadway, Union Beach, NJ: On or about 7/28/2014 two K&M Contracting employees were working in a 4 foot deep trench excavation. They were exposed to caught-in hazards due to excess water accumulation in the bottom causing visible deterioration of the side walls.
