29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  (a)  At Eharas Services and Solutions Inc.:  The employer failed to have an effective Hearing Conservation Program.  (1)  An employee working at the ten inch trim saw was exposed to  continuous noise levels at 248.1%  of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 96.5 dBA.  The sampling was performed for 454 minutes during one shift on August 8, 2014.  (2)  An employee working with nail gun was exposed to continuous noise levels at 107.6%  of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 90.5 dBA.  The sampling was performed for 386 minutes during one shift on August 8, 2014.  (3)  An employee working with nail gun was exposed to continuous noise levels at 96.9%  of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 89.7 dBA.  The sampling was performed for 443 minutes during one shift on August 8, 2014.

(1)  On or about August 8, 2014, an employee working in the wood cutting area, was exposed to an 8 hour time weighted average (TWA) level of 27.2 mg/m3 of respirable dust, which is 5.44 times the OSHA permissible exposure level (PEL) of 5.0 mg/m3.
