29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems:      (a)Murray, Daniel dba MDB Builders, LLC at 642 Rawlins Way, Lafayette, CO 80026: On and before August 2nd, 2014, the exposing employer did not ensure that employees were protected from falling when working on the second floor in the following instances:        1)  The wall opening for the doorway was not guarded with a standard guardrail;        2)  The wall openings for 7 windows, with window sills measuring 36 inches high, were not guarded with a standard top rail;        3)  The employees were installing walls around the stairway floor openings, and were not wearing personal fall arrest systems.    The conditions exposed employees to fall hazards of up to 10 feet.    Abatement note:  29 CFR 1926.502(b) defines a standard guardrails as a top rail 42 inches high, plus/minus 3 inches, plus a mid rail.

The employees used a six-foot Husky stepladder, Model 01-46002-00, to access the second floor, and there was a 42 inch distance between the second floor landing and the top of the stepladder, and 66 inches from the top functional step (second step down) to the second floor landing.  The condition exposed employees to a fall hazard of up to 10 feet.
