29 CFR 1926.760(a)(1): 29 CFR 1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who was on a walking/working surface with an unprotected side or edge more than 15 feet* (4.6m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems: a) 2117 N. Dupont Highway, New Castle, DE - Two employees were exposed to a 19 ft. fall hazard without conventional fall protection, while making modifications to a previously installed deck. The work did not involve connectors work and they were not in a controlled decking zone. Observed on or about 8/5/2014. NOTE: Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

Dupont Highway, New Castle, DE- Two employees were using a ladder to access the top of a canopy approximately 13 ft. above ground level, with a ladder which was not extended 3 feet above the landing. Observed on or about 8/5/2014. NOTE: Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
