29 CFR 1910.146(d)(2): Under the permit space program required by paragraph (c)(4) of this section, the employer shall identify and evaluate the hazards of permit spaces before employees enter them: a) On or about June 5, 2014, Dukane Precast Incorporated had not evaluated the potential atmospheric hazards posed by the presence of natural gas at the Batch Plant Drive-Over Pit before an authorized employee entered the permit space for cleaning. b) On or about June 24, 2014, Dukane Precast Incorporated had not evaluated the potential atmospheric hazards posed by the presence of natural gas at the Burnham Boiler before an authorized employee entered the permit space for cleaning and maintenance. Thereby, employee(s) required to enter the permit spaces for cleaning and maintenance were exposed to a potential hazardous atmosphere: (1) Flammable gas in excess of 10 percent of it's lower flammable limit (2) Atmospheric oxygen concentration below 19.5 percent.

29 CFR 1910.146(d)(3)(iii): Under the permit space program required by paragraph (c)(4) of this section, the employer shall develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including, but not limited to, isolating the permit space: a) On or about June 5, 2014, Dukane Precast Incorporated had not developed and implemented the means, procedures, and practices for isolating the Batch Plant Drive-Over Pit from the potential atmospheric hazards posed by the presence of natural gas during an authorized entry for cleaning. b) On or about June 24, 2014, Dukane Precast Incorporated had not developed and implemented the means, procedures, and practices for isolating the Burnham Boiler from the potential atmospheric hazards posed by the presence of natural gas during an authorized entry for cleaning and maintenance. Thereby, employee(s) required to enter the permit spaces for cleaning and maintenance were exposed to a potential hazardous atmosphere: (1) Flammable gas in excess of 10 percent of it's lower flammable limit (2) Atmospheric oxygen concentration below 19.5 percent.

The written program shall be available for inspection by employees and their authorized representatives: On or about August 4, 2014, in the facility, employees performing batch plant and maintenance operations were required to enter permit spaces, including, but not limited to, the Batch Plant Drive-Over Pit and Cement Mixer, for cleaning and maintenance. The employer did not develop a written permit space program that complied with this section in that the employer's written confined space entry program did not contain specific written procedures for each type of permit space entered.
