An employee performing siding operations on a ladder jack scaffold system, was not being protected from a 17-foot 2-inch fall hazard by use of a personal fall arrest system. b. Employees performing siding operations on a ladder jack scaffold system are not being protected from a 11-foot 3-inch fall hazard by use of a personal fall arrest system. Pursuant to CFR 1903.9, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from falls (An abatement plan and periodic progress reports may also be required if the abatement period is more than 90 days).
