The employer had not complied with the provisions of 29 CFR 1926.652(b)(2) in that the excavation was sloped at an angle steeper than one horizontal to one vertical (45 degrees measured from the horizontal):    a) Work Site: Pawnee Avenue & Carlson Place, Parsippany, NJ.  Employees working in an excavation were exposed to struck-by and crushing injuries in the up to 6 1/2 foot deep excavation which was not adequately sloped, benched or protected by shields or shoring.
