29 CFR 1926.252(a): Whenever materials are dropped more than 20 feet to any point lying outside the exterior walls of the building, an enclosed chute of wood, or equivalent material, shall be used. For the purpose of this paragraph, an enclosed chute is a slide, closed in on all sides, through which material is moved from a high place to a lower one: a. On or about August 14, 2014, at the above addressed jobsite, employees performing roof tear off operations were dropping material approximately thirty-five (35) feet to the ground with no chute in place, thereby exposing employee(s) to struck-by hazards.

29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted: a. On or about August 14, 2014, at the above addressed jobsite, employees performing roofing operations on a low sloped roof, approximately thirty-five (35) feet above the ground were not protected from falls, thereby exposing the employees to fall hazards. ELITE ROOFING & CONSTRUCTION INCORPORATED WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(B)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 454653, CITATION NUMBER 1 , ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON OCTOBER 03, 2012, WITH RESPECT TO A WORKPLACE LOCATED AT 14700 THROUGH 14706 KENTON AVE, MIDLOTHIAN, IL.
