29 CFR 1926.501(b)(15): Each employee on a walking/working surface 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system: a) On or about 08/14/14, in the mechanical room of construction site at Cloverbank Elementary School, 2761 Cloverbank Rd., Hamburg, NY: An employee was sitting on top of and at the edge of a recently installed commercial type hot water tank. The employee was hooking in a hot water return at the wall and was exposed to a fall of 8 ft. to the concrete floor below. No guardrail system, safety net system, personal fall arrest system or other fall protection system was being used. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous: a) On or about 08/14/14, in the mechanical room of construction site at Cloverbank Elementary School, 2761 Cloverbank Rd., Hamburg, NY: An employee used a DeWalt Drill to drill an anchor hole in the wall. The drill was connected to 120 volt-ac power via a series of two extension cords, the first of which was plugged into a wall receptacle. The plug on the second extension cord (the black extension cord) lacked a ground prong. NO ABATEMENT CERTIFICATION REQUIRED
