29 CFR 1910.178(l)(4)(i): Refresher training in relevant topics was not provided to the operator who had been involved in an accident or near-miss incident:    Wal-Mart Associates, Inc.  dba Wal-Mart Stores, Inc. 12850 L Street, Omaha, NE: The employer is failing to retrain forklift operators who had been involved in an incident that resulted in an injury to another employee. On or about 7-28-14 an employee of Wal-Mart Stores, Inc. was injured when the operator of a motorized pallet jack crushed the employee's foot between a cart and a pallet in the aisle where the employee was standing. After the incident the operator was allowed to continue using Powered Industrial Vehicles without the employer retraining the operator.
