Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: A.) Custom Tool & Design, Inc., 4962 Pittsburgh Avenue, Erie, PA 16509, on or about August 14, 2014 and times prior thereto, employees were exposed to crush and impact hazards from powered industrial trucks that were not equipped with proper safety equipment / operator restraint systems. The Clark C500S100 (S/N: 915-0016-6046-CB) forklift was not equipped with an operator restraint system (i.e. seat belt). Employees operate the forklift for activities including, but not limited to, loading and unloading semi-trailers and box trucks.

The propane cylinder was not secured to the forklift truck with the provided bracket.
