29 CFR 1926.452(w)(2): Scaffold casters and wheels were not locked with positive wheel and/or wheel and swivel locks, or equivalent means, to prevent movement of the scaffold while the scaffold was used in a stationary manner: a) 4167 Dupont Highway, Smyrna, DE - Employees were conducting masonry work from a mobile scaffold which did not have a function wheel lock device during operation. Observed on or about 6/17/14. Note: Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) 4167 Dupont Highway, Smyrna, DE - Employees were conducting masonry work from an elevated surface, approximately 14 feet above grade, without utilizing any means of fall protection. Observed on or about 6/17/14. Note: Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.
