29 CFR 1926.28(a): The employer was responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees: At the worksite: On or about August 21, 2014, the employer did not require the use of personal protective equipment, high visibility apparel or vest, to protect employees from vehicle traffic while working in a work zone. Employees were exposed to the hazards of struck-by and caught in between.

Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition), which are incorporated by reference in ��1926.200(g)(2). At the worksite: On or about August 21, 2014, the employer did not have a flagger for signaling vehicle traffic in a work zone with workers present. Employees were exposed to the hazards of struck-by and caught in between.
