Condition observed on/or about August 23, 2014.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above the lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of 29 CFR 1926.502(k) developed and implemented: a) 5 - 7 Shadowlawn Drive, Somerset, NJ: Employees were observed performing roofing operations at a height of approximately 23' to the roof eave to the ground below with no fall protection in place, exposing them to fall hazards. Condition observed on or about August 23, 2014. RCS Contractor LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 945393, citation number 1, item number 1 and was affirmed as a final order on 03/07/2014, with respect to a workplace located at Bldg. 8 Veterans Memorial Drive, Raritan, NJ 08869.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) 1501 Rahway Road, Scotch Plain, NJ: Employees were allowed to use a ladder that was not secured and did not extend 3 feet above the working surface to allow for safe access on and off the roof and the second level of the home being constructed. Condition observed on or about July 23, 2014.
