29 CFR 1910.178(n)(1): The employer did not ensure all traffic regulations were observed. (a): At the East Dock, the employer did not ensure forklift operator(s) followed safety regulations, such as but not limited to being mindful of pedestrian traffic, keeping a clear view of the direction of travel, and keeping bystanders at a safe distance from the forklift. IN THE ALTERNATIVE: 29 CFR 1910.178(n)(6): Industrial truck drivers were not required to look in the direction of, and keep a clear view of the path of travel: (a) At the East Dock, the employer did not ensure that forklift operators looked in the direction of travel to avoid striking pedestrians and/or bystanders.
