29 CFR 1910.38(c)(4): The Emergency Action Plan did not include procedures to account for all employees after evacuation.  On 8/25/2014, at the Decatur location, the employer's Emergency Action Plan did not account for employees assigned to assist in shut down of the facility once employees evacuated.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.147(c)(4)(ii)(C): The energy control procedure did not clearly and specifically outline the steps for placement, removal and transfer of lockout devices or tagout devices and the responsibility for them.  On 8/25/14, at the Decatur facility, authorized employees using locks for service and maintenance purposes do not keep the keys to the locks under their control and instead hang them in an accessible key station available to all employees.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.147(c)(5)(ii): Lockout devices and tagout devices were not used for lockout and tagout purposes only.  On or about 8/25/14, lockout locks and tags were used for purposes other than service and maintenance of equipment in the Boiler Room of the facility. Locks were used to keep equipment on Boiler 2 in the "On" position so as employees would not turn valves and lockout tags were used to keep Boiler 1 Blow Down Lines from being turned on.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.305(j)(1)(iv): Fixtures installed in wet or damp locations were not approved for the purpose and were not so constructed or installed that water could not enter or accumulate in wireways, lampholders, or other electrical parts.  On 8/25/14, in the Food Service area, receptacles installed in wet locations were not protected from water and water over spray as receptacle covers were not in place and hadn't been replaced or repaired.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed.  On 8/25/14, the employer has not conducted a periodic inspection in approximately 2 years and after the implementation of written specific lockout procedures were implemented at the facility in December 2012. Deficiencies in the program included not having a documented group lockout procedure and requiring electrical equipment only over 300 volts to be locked out.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.  The U.S. Department of Veterans Affairs was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.147(c)(6)(i), which was contained in OSHA inspection number 311680862, citation number 1, item number 2 and was affirmed as a final order on 8/20/2010, with respect to a workplace located at 510 Butler Avenue, Martinsburg, WV 25401.
