29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).    The employer does not protect employees from falling when working 6 feet or more above lower levels. This violation was observed on or about August 26, 2014, at the construction site where employees were exposed to an approximate 15 foot fall hazard when performing framing activities on a residential structure without a fall protection system.    The J Medina Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection 983791, citation 1 , item 1 and was affirmed as a final order on July 29, 2014, with respect to a workplace located at 177 Finn Corner Way, The Woodlands, TX 77389.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in residential construction activities 6 feet or more above lower levels are protected from falling.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed.    The employer does not ensure that a portable ladder was used for the purpose in which it was designed. This violation occurred on or about August 26, 2014, at the jobsite where an employee was exposed to a fall hazard when using an 6 foot step ladder to gain access to the second story frame for which it was not designed.     The J Medina Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection 316065390, citation 1 , item 3 and was affirmed as a final order on January 10, 2012, with respect to a workplace located at 12778 Yorkstone Dr., Houston, TX 77041.    Pursuant to 29 C.F.R. 1903.19, within one (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all ladders used by employees are used for the purpose for which they were designed.
