29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On or about August 21, 2014: a) Employees utilizing an extension ladder to gain access to the upper landing of the working area, were exposed to fall hazards of approximately 12.3 feet when the rails of the ladder did not extend at least three feet above the upper landing area.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about August 21, 2014: a) Employees installing roof sheathing on a new residential home were exposed to fall hazards of 12.3 feet and 20.2 feet while installing roof sheathing on a roofing system with a pitch of 8 in 12 without the use of fall protection measures. The Everardo Malagon was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 551499, citation number 1, item number 2 and was affirmed as a final order on October 30, 2012, with respect to a workplace located at 1110 Krobot Way Roswell, GA 30102.
