OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards posed by combustible metal dust:  Original Equipment Manufacturer (OEM) De-burring Area:  On, or about, August 29, 2014, the following hazards were observed:   A dust collection system that consisted of plastic hose, ductwork and a Tempest cyclone dry-type dust collector (Model DC15MBOHP) served three workstations where employees de-burred and finished parts made of titanium, Inconel alloy and/or stainless steel.  Employees at the workstations used hand tools such as Dremels to remove excess metal from the parts.  The process generated combustible metal dust.  The nature of the process  e.g. applying friction to metal parts, in particular hard metals such as Iconel alloy and stainless steel  created the potential for a spark or hot ember to enter the dust collection system.       The dust collector had not been designed, installed, or maintained to protect employees against fire and explosion hazards from combustible metal dusts.  Among other things, the collector was not arranged to minimize potential ignition sources.  The ducts of the collector were not constructed of conductive material, or with smooth interior surfaces, to reduce the likelihood of static discharge. The collector pulled dust laden air through the fan assembly, causing contact between dust particles and fast moving parts.  Further, the system was not operated in such a way to reduce accumulations of combustible dust inside and outside the collector.  The collector lacked sufficient capture velocity to capture the combustible dust generated at the workstations, and the combustible dust that was collected in the system was not removed daily.  Finally, the collector system was not arranged to prevent or mitigate employee exposure to potential fire/explosion hazards.  The system was not equipped with explosion protection, explosion isolation or a fixed fire suppression system.  The collector was located inside the building and recycled exhaust air inside the building into the area above the workstations.  The collector was not equipped with a data plate and/or visible warning label to inform employees of combustible dust hazards associated with the collector.

29 CFR 1910.107(j)(1): Drying, curing, or fusion apparatus in connection with spray application of flammable and combustible finishes did not conform to the Standard for Ovens and Furnaces, NFPA 86A-1969, which is incorporated by reference as specified in 29 CFR 1910.6:     Paint Room:  On, or about, August 29, 2014, parts that had been painted/coated with Amtex RC-21, a Category 2 flammable liquid, were cured in Oven 77, a Grieve industrial oven, Model TA-500, serial number 641062.  The oven was not designed for use with flammable solvents and a yellow placard was affixed to the exterior of the oven that stated that it was not for use with flammable solvents.
