OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to  chemical exposure hazards while releasing the air pressure from tank trailers during leak testing.  a)  Work bay:  On or about September 9, 2014 and at times prior, the employer failed to ensure that employees are not exposed to chemical burns in that the employer does not ensure all tanks entering the facility are free of contamination prior to performing pressure testing on the tanks where the interior pressurized air of the tank is vented into the workplace at the conclusion of the test.

Work Bay: On or about September 9, 2014: The employer failed to provide a means to guard employees from hazardous materials and energy in that the employer required employees to open valves on tank trailers without providing a means to divert the released materials or energy away from the area the employee is required to stand.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  (a) Facility: On or about September 9, 2014: the employer exposed employees to hazardous chemicals in that employees were allowed to inspect and pressure test tank trailers without personal protective equipment appropriate for the type of chemicals they would be exposed to. The employer failed to conduct a workplace hazard assessment to determine the hazards present and the necessary personal protective equipment to protect employees from those hazards.
