29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) (a) On or about September 9, 2014, at the VA Medical Center located at 1030 Jefferson Ave, Memphis, TN, Albro Davis Construction employees were exposed to various hazardous materials (including but not limited to WD40, ZEP Sweep Compound, All Purpose Joint Compound, DAP Latex Caulk) and did not have a copy of their written hazard communication program on site. Without proper information on hazardous materials, employees could mis-handle hazardous materials and expose themselves to skin, eye, and respiratory irritations. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(e)(1)(i): The employer did not compile a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet. (a) On or about September 9, 2014, at the VA Medical Center located at 1030 Jefferson Ave, Memphis, TN, Albro Davis Construction employees were exposed to various hazardous materials (including but not limited to WD40, ZEP Sweep Compound, All Purpose Joint Compound, DAP Latex Caulk) and did not compile and make available a chemical list of materials used on site. Without proper information on hazardous materials, employees could mis-handle hazardous materials and expose themselves to skin, eye, and respiratory irritations.
