29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns.  On 9/4/14, at the Bogan Meadows job site, employees working below employees on pump jack scaffolds were not using head protection to protect them overhead hazards.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration: Such activities were not performed only by experienced and trained employees selected for such work by the competent person.  On or about 9/4/14, at the Bogan Meadows job site, the employer did not ensure pump jack scaffolds used at the job site were inspected by a competent person prior to permitting employees to work from the scaffolds. The scaffolds were being used without fall protection provided to employees on the scaffolds.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level.   On 9/4/14, at the Bogan Meadows job site, employees were exposed to fall hazards greater than 15 feet and were not using fall protection as they installed siding from pump jack scaffolds.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  On 9/4/14, the employer did not establish a training program for employees working on and around scaffolds to educate them in hazards associated with that type work.
