29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  (Construction Reference 1926.103)  On or about September 18, 2014, at the above addressed jobsite, the employer did not provide the information contained in Appendix D of 29 CFR 1910.134 for employees wearing 3M 8200 N95 filtering face piece respirators while performing cutting concrete pipe operation.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program which included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): (Construction Reference: 1926.59)(a)  On or about September 18, 2014, at the above addressed jobsite, the employer did not have a written hazard communication program that addressed the hazards for hazardous chemicals, such as but limited to, Portland Cement, silica dust and gasoline for employees performing cutting concrete pipe and mixing cement operation.
