29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection by placing and keeping such materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary was not provided: a. On or about September 22, 2014, employees in the 8 feet deep excavation were exposed to being struck by the John Deere 210 excavator in that it was not located at least 2 feet from the top of the west edge of the excavation. b. On or about September 22, 2014, employees in the 8 feet deep excavation were exposed to being struck by the John Deere 60 excavator in that it was not located at least 2 feet from the top of the east edge of the excavation.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a. On or about September 22, 2014, in the 8 feet deep excavation, employees installing a force main sewer pipe were exposed to a cave-in hazard in that they were not protected by an adequate protective system.
