Roeder Construction was issued violations of the Occupational Safety and Health Act on February 3, 2014. As of April 3, 2015, the employer has failed to provide abatement verification for Citation 1, Item 1 & 2, and Citation 2 - Item 1, within 10 calendar day requirement posted in the citation.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of �1926.502(k) developed and implemented: The employer is failing to ensure that adequate fall protection is provided for employees who are working on the roof of a home which is approximately 16 feet from a lower level. This occurred on September 15, 2014 at 1503 W. 4th St., Grand Island, NE 68801. An employee sustained fatal injuries when he and another employee who sustained non-fatal injuries fell off of a roof during roofing activities that involved putting tarpaulin on the roof. Additionally, the employer failed to provide fall protection on or about September 18th at 1503 W. 4th St., Grand Island, NE 68801 when two employees were working on the roof to complete the roofing job. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed.

29 CFR 1904.39(a): An oral report of an employment accident resulting in a fatality or the inpatient hospitalization of three or more employees was not made within eight (8) hours after the occurrence to the nearest Area Office of the Occupational Safety and Health Administration or to the OSHA toll-free central telephone number (1-800-321-OSHA). The employer failed to ensure that the OSHA Omaha Area Office was notified of a workplace fatality that took place on September 15, 2014 at 1503 W. 4th St., Grand Island, NE 68801 within 8 hours of its occurrence. The Area Office learned of this fatality on September 23, 2014. An employee sustained fatal injuries when they fell of a roof approximately 16 feet during roofing activities that involved putting tarpaulin on the roof. Abatement certification is required for this violation. Abatement certification sheet is enclosed with the citation.
