29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:  a) Worksite: Employees were framing a residential building using a Hitachi pneumatic nail gun with Bostitch nails without eye protection; on or about 9/26/14.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   a) Worksite: Employees framing a residential building from the second story landing and roof approximately 10 ft. and 20 ft. above the ground did not have fall protection; on or about 9/26/14.  Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.  S1J Contractor Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(15)), which was contained in OSHA inspection number 906526, citation number 1, item number 1, and was affirmed as a final order on 8/2/13, with respect to a worksite located at 15 Church St. in Sag Harbor, NY 11963.
