29 CFR 1926.453(b)(2)(iv): Employee(s) were not standing firmly on the floor of the basket, were sitting or climbing on the edge of the basket, or were using planks, ladders, or other devices for a work position:    a) Worksite: Employees were doing framing and sheathing work from a Lull aerial lift model 944E-42. One employee climbed over the edge of the basket of the lift to access the roof of the commercial building approximately 24 ft. above the ground; on or about 3/13/15.    Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:   a) Worksite: Employees were doing framing and sheathing work from a Lull aerial lift model 944E-42, approximately 18 ft. 6 in. above the ground. The employees were not wearing a body belt and/or a lanyard attached to the basket; on or about 3/13/2015.  Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:    a) Worksite: An employee was anchoring the frame from the roof of the new commercial building approximately 24 ft. above the ground without fall protection; on or about 3/13/15. 29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a) Worksite: Employees working directly under ongoing framing and roofing activities from the Lull aerial lift model 944E-42 were not using head protection; on or about 3/13/15.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.    S1J Contractor Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 997034, citation number 1, item number 2, and was affirmed as a final order on 12/18/14, with respect to a worksite located at 325 Montauk Highway in East Quogue, NY 11942.
