29 CFR 1910.1030(c)(1)(iv)(B): The review and update of the exposure control plan did not document annually consideration and implementation of appropriate commercially available and effective safer medical devices designed to eliminate or minimize occupational exposure:  The employer did not ensure that adequate evaluations of safer needle devices were conducted annually in that departments such as but not limited to surgery and dermatology were using non-safety devices and employees with potential exposure to contaminated sharps from non-safety devices were not part of the evaluation or no evaluation had been conducted as the forms were resigned on an annual basis.

29 CFR 1910.1030(d)(2)(i): Engineering and work practice controls were not used to eliminate or minimize employees exposure:  The employer did not ensure that engineering and work practice controls in the dermatology department were adequate in that employees were placing 4 x 4 gauze over contaminated sharps as no means of disposal for the contaminated gauze was available in the work area.

29 CFR 1910.1030(g)(2)(vii)(D): The bloodborne pathogens training program did not contain an explanation of the employer's exposure control plan and the means by which the employee could obtain a copy of the written plan:  The employer did not ensure that annual training included an explanation of the facility's written bloodborne  exposure control plan.  The U.S. Department of Veteran Affairs #552 was previously cited for a violation of this occupational safety and health standard or its equivalent standard , which was contained in OSHA inspection number 315273680, citation number 1, item number 5 and was affirmed as a final order on April 25, 2011, with respect to a workplace located at 4100 West Third Street Dayton, Ohio 45428.
