29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about October 2, 2014, the employer Omar Gonzalez, did not ensure that its employees were protected from falls while working at heights greater than 6 feet. Employees of Omar Gonzalez were exposed to fall hazards in excess of 13 feet while engaged in roofing activities on the roof of a residential building with no fall protection in place. 29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access: (a) On or about October 2, 2014, the employer Omar Gonzalez, did not ensure that portable ladders, used to access upper landing surfaces, extend at least 3 feet above the upper landing surface to which the ladders were used to gain access. Workers were observed using a ladder to access the roof of a residential building. Ladder did not extend at least 3 ft above the landing platform and was not tied to the roof edge. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

(a) On or about October 2, 2014, the employer Omar Gonzalez, did not ensure that portable ladders with structural defects, such as broken rungs, were immediately marked as defective, and were withdrawn from service until repaired. An extension ladder with a broken rung was used to access a roof, exposing employees to fall hazards of up to 13 feet. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
