29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: (a) On or about October 2, 2014, 5 Star Roofing, LLC., did not protect employees working on the ground below roofing operations from overhead falling object hazards by ensuring the employees were wearing hard hats. An employee of 5 Star Roofing, LLC., was observed exposed to overhead falling object hazards, while working below re-roofing operations. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about October 2, 2014, and at times prior, 5 Star Roofing, LLC., did not ensure that its employees were protected from falls while working at heights greater than 6 feet: 1. On October 1, 2014, Employees of 5 Star Roofing, LLC., were exposed to fall hazards in excess of 6 feet while engaged in roofing activities on the roof of a residential building, located at 1923 N. Nevada Avenue, Colorado Springs, CO 80907, with no fall protection in place. 2. On October 2, 2014, Employees of 5 Star Roofing, LLC., were exposed to fall hazards in excess of 12 feet while engaged in roofing activities on the roof of a residential building, located at 1923 N. Nevada Avenue, Colorado Springs, CO 80907, with no fall protection in place. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet"). 5 Star Roofing, LLC., dba Mora's Roofing, 5 Stars Roofing, Luis Esparza-Mora was previously cited for a violation of this occupational safety and health standard or its equivalent standard, CFR 1926.501(b)(13), which was contained in OSHA inspection number 953804, citation number 1, item number 1 and was affirmed as a final order on February 20, 2014, with respect to a workplace located at 119 Avocet Drive, Colorado Springs, CO 80921. 5 Star Roofing, LLC., dba Mora's Roofing, 5 Stars Roofing, Luis Esparza-Mora was previously cited for a violation of this occupational safety and health standard or its equivalent standard, CFR 1926.501(b)(13), which was contained in OSHA inspection number 922153, citation number 1, item number 1 and was affirmed as a final order on August 19, 2010, with respect to a workplace located at 294 Harvard Street, Colorado Springs, CO 80907. 5 Star Roofing, LLC., dba Mora's Roofing, 5 Stars Roofing, Luis Esparza-Mora was previously cited for a violation of this occupational safety and health standard or its equivalent standard, CFR 1926.501(b)(13), which was contained in OSHA inspection number 714998, citation number 1, item number 1 and was affirmed as a final order on November 16, 2012, with respect to a workplace located at 2920 Serendipity Circle, Colorado Springs, CO 80917.
