29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about October 8, 2014, at 1913 Dutton Dr., San Marcos, TX, the employer failed to ensure that employees performing masonry work were not exposed to being struck by the stones that were being placed on the scaffolding. Employees were not wearing head protection when staging or working below the stones. Employees exposed to a struck by hazard from falling stones.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  On or about October 8, 2014, at 1913 Dutton Dr., San Marcos, TX, the employer failed to ensure the employee who was cutting stone with the Dewalt saw had proper eye protection. The employee was not wearing eye protection and was cutting stones for the masons working on the scaffolding. Employee was exposed to an eye injury from being struck by flying stone particles.
