29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:    Wildlife Conservation Society, dba The New York Aquarium, Surf Avenue & W 8th St. Brooklyn, NY 11224: Employees working at the Aqua Theater and Sea Intake Pump Rooms were exposed to noise levels that exceeded 85dbA value based on the limited time frame reported in noise assessment contracted by the employer; however the employer did not develop and implemented a monitoring program that covered the affected employees. The condition was noted on or about 10/08/2014.     NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY  DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
