29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: (i) Excavations are made entirely in stable rock; or (ii) Excavations are less than 5 feet in depth and examination of the ground by a competent person provides no indication of a potential cave-in:    a) Employees were exposed to trench (dirt wall) collapse when working in an 8 ft deep pit which had no shoring.  The employer was excavating to locate a pipe in front of a residence.     Location: 864 Metropolitan Ave, Brooklyn N.Y.    On or about 10/10/2014    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.    a) The employer did not provide a competent person to inspect trenching/ excavation activities so as to ensure employees are protected from trench safety hazards.  Employees were exposed to trench collapse hazard when entering an 8 ft deep trench to repair a water pipe.  The trench was not shored; ladder was damaged.      Location: 864 Metropolitan Ave, Brooklyn N.Y.    On or about 10/10/2014    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects were not immediately marked "Defective, Do not Use" and withdrawn from service:    a) Employees were exposed to fall hazard using a damaged aluminum extension ladder.  Two rungs and the side rail were crushed with one rung pulling loose from the side rail. The ladder was being used for employees to enter an 8 ft deep excavation.
