29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:  Location: Jobsite  Employees were exposed to fall hazards greater than 6 feet, and 10 feet from scaffolds while performing framing operations, and were not trained to recognize or avoid the hazards associated with falls from heights.  Instance 1) Employees were working from a saw horse scaffold 19 inches from an attic balcony edge, where Employees were exposed to fall hazards to the second floor and stairwell leading to the first floor below.  Instance 2) Employees were exposed to fall hazards at unguarded second story wall openings.  Instance 3) Employees were exposed to fall hazards greater than 17 feet to the ground below, while working from a carpenters bracket scaffold.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   Location: Jobsite  Employees were exposed to fall hazard of greater than 6 feet, while working, where fall protection had not been used or provided.  Instance 1) Employees were exposed to fall hazards at a second floor wall opening, where no fall protection was used or provided. No guardrails were installed, and no personal fall arrest system was used. The Employee was accessing a carpenters bracket scaffold from the unguarded second floor wall opening.The pneumatic nail gun airline was routed through this window, verifying exposure to this hazard.  Instance 2) The Foreman and an employee was exposed to a fall hazard greater than 9 feet at an unguarded attic edge, while working from a man-made saw horse scaffold approximately 19 inches from the attic edge. The Foreman and the Employee were exposed to fall hazards to the second floor, and through the stairwell to the first floor.

Location: Jobsite  Employees were exposed to fall hazards greater than 6 feet, while framing the second floor, where a stairwell floor opening was not properly guarded with a midrail.
